This website is owned and operated by The Activ Group Solutions Pty Ltd (ABN 64 640 456 971) (“Activ Group”). Ecoactiv Pty Ltd (“Ecoactiv”), a member of Activ Group, administers the Sony Trade In. Trade Up. Powered by Ecoactiv program (“Program”).

By participating in the Program, you agree to these Terms and Conditions (“Terms”), which incorporate our Privacy Policy. You should review these Terms and our Privacy Policy carefully and immediately cease participating in the Program if you do not agree.

In these Terms:

• “you”, “your” means the individual or entity submitting equipment under the Program.
  
  

• “Ecoactiv”, “we”, “us”, or “our” means Ecoactiv, acting as administrator of the Program on behalf of Activ Group.
  
  

• “Program” means the Sony Trade In. Trade Up. Powered by Ecoactiv program as described in these Terms.
  
  

• “Equipment” means the items submitted by you for trade-in under the Program.
  
  

• “Evaluation Partner” means a third-party service provider authorised by Ecoactiv to inspect and value equipment.

2. Eligibility

• By submitting equipment under this Program, you represent and warrant that you are legally entitled to enter into this agreement and that you are the lawful owner of the equipment submitted, free from any security interest, lien, or third-party claim.

• Participation in the Program is at the sole discretion of Ecoactiv. Ecoactiv may refuse or cancel participation if:

  • the equipment submitted is not included in the list of accepted products;

  • the equipment is not submitted in accordance with these Terms; or

  • Ecoactiv determines, acting reasonably, that participation would contravene law, pose a risk of fraud, or otherwise be inappropriate.

2. Estimates & Final Valuation

• Any estimate provided on the Program website is indicative only and does not constitute a binding offer.

• Estimates may be varied after review of photos, descriptions, and supporting information provided by you.

• The final trade-in value will be determined only after physical inspection of the Equipment by Ecoactiv and/or an authorised Evaluation Partner.

• Ecoactiv and its Evaluation Partners may revise or withdraw any offer where the Equipment’s actual condition differs from the declared condition, or where the Equipment is found to be ineligible.

• Trade-in offers are valid for thirty (30) calendar days from the date of issue unless expressly stated otherwise.
  
  

3. Condition Criteria

• You must provide an accurate declaration of the functional and cosmetic condition of your Equipment, including disclosure of faults, defects, missing parts, or cosmetic damage.

• Upon inspection, the trade-in value may be reduced or the Equipment rejected if:

  • the Equipment exhibits faults, defects, or cosmetic damage not disclosed at submission;

  • the Equipment is in a lower functional or cosmetic condition than represented; or

  • any declared accessories, components, or parts are missing.

• In such circumstances, Ecoactiv will issue a revised trade-in value reflecting the actual condition, or reject the Equipment and provide the option for return under clause 7.

4. Packaging & Shipping

• You are solely responsible for ensuring that the Equipment is securely packaged to withstand transit.

• Ecoactiv is not liable for any loss, theft, damage, or deterioration occurring in transit to the evaluation centre.

• Where provided, shipping labels cover postage charges only. Packaging materials are your responsibility.

5. Ownership & Legitimacy

• By submitting Equipment, you represent and warrant that:

  • you are the sole legal and beneficial owner of the Equipment;

  • the Equipment is not counterfeit, stolen, or subject to any third-party rights; and

  • you have full authority to transfer ownership to Ecoactiv.

• Equipment suspected to be counterfeit, stolen, or unlawfully obtained may be reported to law enforcement agencies, including the police, and retained as required by law.

6. Returns

• Once Equipment is received by Ecoactiv or an authorised Evaluation Partner, ownership passes to Ecoactiv unless you decline the final trade-in offer.

• If you decline the final offer, you may request the return of your Equipment.

• Returns will only be processed once you have paid any applicable processing and shipping fees, as advised by Ecoactiv.

• Ecoactiv is under no obligation to return Equipment where it is determined to be counterfeit, stolen, or otherwise unlawful.

7. Vouchers & Rewards

• Upon acceptance of the final trade-in offer, Ecoactiv will issue your reward in the form of Sony Store discount coupons.

• Vouchers will be delivered by email within ten (10) business days of final inspection and approval.

• Vouchers are:

  • Non-transferable;

  • not redeemable for cash or any other consideration; and

  • incapable of replacement if lost, stolen, deleted, or otherwise misplaced after delivery.

• Vouchers are governed solely by Sony’s terms and conditions of use, available at https://store.sony.com.au/di-trade-in-terms.html, and may be redeemed only at the Sony Store online.

• Ecoactiv and Activ Group have no responsibility for the redemption, validity, or use of vouchers once issued.

8. Data Responsibility

• You are solely responsible for deleting all personal data, accounts, and media from your Equipment prior to submission.

• Ecoactiv accepts no responsibility for, and shall not be liable in connection with, any data, accounts, or content remaining on Equipment, or for any loss, disclosure, or misuse of such data.

9. Program Changes

• Ecoactiv may amend, suspend, or terminate the Program at any time without notice.

• Any determination by Ecoactiv or its authorised Evaluation Partners in relation to trade-in values, eligibility, or the issuance of vouchers shall be final and binding.

10. Liability

• To the fullest extent permitted by law, Ecoactiv excludes all liability for any loss, damage, cost, or claim arising out of or in connection with your participation in the Program, including but not limited to:

  • the condition of Equipment upon arrival at the evaluation centre;
    
    

  • any findings or determinations made by Evaluation Partners; and

  • any delays in processing or issuing vouchers.

• Nothing in these Terms excludes or limits any rights you may have under the Australian Consumer Law.

11. Governing Law

• These Terms are governed by the laws of Victoria, Australia.

• The courts of Victoria shall have exclusive jurisdiction over any dispute arising out of or in connection with the Program.
